Terms of use

These terms govern your use of Basketly (getbasketly.com and related services). By creating an account or using the platform, you agree to them. Please also read our Privacy policy, Risk disclosure, and Compliance notice, which are incorporated into these terms by reference.

1. What Basketly is

Basketly is a software platform that lets you build, browse, and track thematic collections of stocks ("baskets"), and — if you choose to connect a brokerage account — submit buy and sell orders for the stocks in a basket through that brokerage's official API, on your explicit instruction.

Basketly is not a registered investment adviser, broker-dealer, custodian, or financial planner in Canada, the United States, or any other jurisdiction. We do not hold your funds or securities, do not have discretionary authority over your account, and do not place any trade without your specific, individual instruction for that trade.

2. Eligibility

To use Basketly, you must:

  • Be at least 18 years old (or the age of majority in your province, state, or territory)
  • Be a legal resident of Canada, the United States, the United Kingdom, a member state of the European Union, or Australia
  • Have the legal capacity to enter into a binding contract
  • Not be barred from using brokerage or financial services under applicable law

If you connect a brokerage account, you must also meet that brokerage's own eligibility and account-opening requirements — Basketly has no role in, and no visibility into, your brokerage's approval decision.

3. Your account

You're responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away at contact@getbasketly.com if you suspect unauthorized access. You agree to provide accurate information when creating your account and to keep it up to date.

4. Connecting a brokerage account

Brokerage connections are established via SnapTrade's official API, using OAuth authentication — Basketly never sees or stores your brokerage username or password. Once connected, you can authorize Basketly to submit orders (invest, buy more, rebalance, exit, or sell) to that account. Every such order is initiated by an explicit action you take in the app — Basketly does not trade on your account automatically, with one exception: an active SIP (recurring investment) plan you've explicitly created and left active will place orders on the schedule you set, until you pause or cancel it.

Order execution, settlement, custody of your funds and securities, and account statements are all handled entirely by your connected brokerage, not Basketly. Any dispute about an order's execution price, timing, or fill should be raised with your brokerage; Basketly can help you understand what was submitted, but does not control how it was filled.

5. No investment advice

Nothing on Basketly — including curated basket theses, fact-sheet analytics, performance charts, sector breakdowns, or any other content — is investment advice, a recommendation, or a solicitation to buy or sell any security. Basket compositions and any historical performance shown are for informational purposes only. You are solely responsible for deciding whether any basket or trade is suitable for you, and we encourage you to consult a qualified, licensed financial adviser before investing.

6. Fees and plans

Basketly offers a free plan and a paid Premium plan. Free-plan accounts can build and browse baskets, and can sell, exit, or manage existing positions, but cannot connect a new brokerage account or place buy orders — those actions require Premium. Current pricing is posted on our pricing page and may change; we'll give notice before any change takes effect for existing subscribers. Fees paid to Basketly are separate from, and in addition to, any fees, commissions, or spreads your brokerage charges you directly.

7. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose, or in violation of any securities law or regulation
  • Attempt to gain unauthorized access to any account, system, or data
  • Interfere with or disrupt the platform's operation, or attempt to reverse-engineer it
  • Use automated means (bots, scrapers) to access the platform outside of documented APIs
  • Misrepresent your identity or provide false information
  • Use the platform to launder money or engage in market manipulation

8. Intellectual property

Basketly and its content, design, and branding are owned by Basketly Inc. and protected by copyright and trademark law. Custom baskets you create remain yours to use, share, or delete; by making a basket public, you grant other users a license to view it (not to copy it wholesale for commercial redistribution).

9. Disclaimers and limitation of liability

The platform is provided "as is," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We don't guarantee that price data, quotes, or historical performance figures are error-free or uninterrupted — they're sourced from third-party market data providers and may be delayed, incomplete, or occasionally inaccurate.

To the maximum extent permitted by law, Basketly Inc. is not liable for any indirect, incidental, or consequential damages — including investment losses — arising from your use of the platform. Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable Canadian or US law.

10. Indemnification

You agree to indemnify and hold Basketly Inc. harmless from claims arising out of your violation of these terms, your misuse of the platform, or your violation of any law or third party's rights.

11. Termination

You may close your account at any time from your account settings. We may suspend or terminate your access if you violate these terms, if required by law, or if we reasonably believe your account poses a fraud or security risk. Closing your account does not affect any brokerage account you hold directly with your brokerage — that relationship continues independently of Basketly.

12. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, for all users regardless of location. If you're a resident of the United States, the United Kingdom, a European Union member state, or Australia, this does not waive any consumer protection rights you have under your home jurisdiction's law that cannot be waived by contract — including, where applicable, your right to bring a claim before the courts of your own country as a consumer. Any dispute will first be attempted to be resolved informally by contacting contact@getbasketly.com.

13. Changes to these terms

We may update these terms from time to time. We'll post the updated version here with a new "Last updated" date, and for material changes, we'll make reasonable efforts to notify you directly (e.g. by email). Continued use of Basketly after a change takes effect means you accept the updated terms.
